Official Summary

6/16/2008--Reported to Senate amended. Lower Colorado River Multi-Species Conservation Program Act - Authorizes the Secretary of the Interior to:
(1) manage and implement the Lower Colorado River Multi-Species Conservation Program; and
(2) enter into an agreement with Arizona, California, and Nevada providing for the use of water from the Lower Colorado River for habitat creation and maintenance in accordance with the Habitat Conservation Plan, Biological Assessment and Biological and Conference Opinion, Environmental Impact Statement/Environmental Impact Report, Funding and Management Agreement, Implementing Agreement, and a specified permit issued and executed in connection with the Program. Authorizes appropriations.
Allows any party to the Funding and Management Agreement or the Implementing Agreement and any permittee under the permit to commence a civil action in U.S. district court to adjudicate rights and obligations of the parties under the program documents. Permits the United States or any U.S. agency to be named as a defendant in such actions. Waives the sovereign immunity of the United States for purposes of such actions, except as to claims seeking money from the United States.
