6/20/2008--Public Law. (This measure has not been amended since it was passed by the Senate on May 22, 2008. The summary of that version is repeated here.) Federal Food Donation Act of 2008 - Requires the Federal Acquisition Regulation to be revised to require all government contracts above $25,000 for the provision, service, or sale of food in the United States, or for the lease or rental of federal property to a private entity for events at which food is provided in the United States, to include clauses that:(1) encourage the donation of excess, apparently wholesome food to nonprofit organizations that provide assistance to people with inconsistent access to sufficient, safe, and nutritious food;
(2) provide that the head of an executive agency involved shall not assume responsibility for the costs and logistics of collecting, transporting, maintaining the safety of, or distributing such food; and
(3) exempt any executive agency and any contractor making donations pursuant to such a contract from liability to the extent provided under the Bill Emerson Good Samaritan Food Donation Act.
