My mother recently died due to medical malpractice and neglect while she was a resident in a nursing home. I had to sign an arbitration agreement prior to her admission, which prevents me from filing a wrongful death lawsuit against the facility. Arbitration agreements are an abomination. Elderly people should not have to waiver their constitutionally guaranteed right to a fair jury trial in order to receive services. Litigation would serve as a deterrent to abuse and neglect.
