Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,CommentsClose CommentsPermalink
SECTION 1. SHORT TITLE.
This Act may be cited as the `Help to Access Land for the Education of Scouts' or `HALE Scouts Act'.CommentsClose CommentsPermalink
SEC. 2. FINDING.
Congress finds that it is in the public interest to provide for the conveyance of certain Federal land in the Ouachita National Forest in Oklahoma to the Indian Nations Council, Inc., of the Boy Scouts of America, in exchange for consideration equal to the amount of the market value of the land.CommentsClose CommentsPermalink
SEC. 3. DEFINITIONS.
In this Act:CommentsClose CommentsPermalink
(1) COUNCIL- The term `Council' means the Indian Nations Council, Inc., of the Boy Scouts of America.CommentsClose CommentsPermalink
(2) FOREST- The term `Forest' means the Ouachita National Forest in the State of Oklahoma.CommentsClose CommentsPermalink
(3) MAP- The term `map' means the map entitled `Boy Scout Land Request-Ouachita NF'.CommentsClose CommentsPermalink
(4) SECRETARY- The term `Secretary' means the Secretary of Agriculture.CommentsClose CommentsPermalink
SEC. 4. LAND CONVEYANCE, OUACHITA NATIONAL FOREST, OKLAHOMA.
(a) Conveyance Required-CommentsClose CommentsPermalink
(1) IN GENERAL- Subject to valid existing rights, the Secretary shall convey to the Council, by quitclaim deed, all right, title, and interest of the United States in and to the National Forest System land described in subsection (b).CommentsClose CommentsPermalink
(2) EXCLUSION- The conveyance under paragraph (1) shall exclude any land located within the Indian Nations National Scenic and Wildlife Area designated by section 10 of the Winding Stair Mountain National Recreation and Wilderness Area Act (
(b) Description of Land- The National Forest System land referred to in subsection (a) consists of the approximately 140 acres of land in the Forest, depending on the final measurement of the road set back and the actual size of the affected sections, as depicted on the map.CommentsClose CommentsPermalink
(c) Availability of Map- The map shall be on file and available for public inspection in the Forest Service regional office in Atlanta, Georgia.CommentsClose CommentsPermalink
(d) Amount of Consideration- As consideration for the land conveyed under subsection (a), the Council shall pay to the Secretary an amount equal to the fair market value of the land, as determined by an appraisal conducted in accordance with subsection (f)(2).CommentsClose CommentsPermalink
(e) Use of Proceeds-CommentsClose CommentsPermalink
(1) IN GENERAL- Amounts received under subsection (d) shall be deposited in the fund established by
(2) ACQUISITION OF LAND- Amounts deposited under paragraph (1) shall be available to the Secretary, without further appropriation, to acquire land and interests in land in the Forest.CommentsClose CommentsPermalink
(f) Survey and Appraisals-CommentsClose CommentsPermalink
(1) SURVEY- The exact acreage and legal description of the land to be conveyed under subsection (a) shall be determined by a survey that is satisfactory to the Secretary.CommentsClose CommentsPermalink
(2) APPRAISAL- The appraisal required under subsection (d) shall be--CommentsClose CommentsPermalink
(A) conducted in accordance with--CommentsClose CommentsPermalink
(i) the Uniform Appraisal Standards for Federal Land Acquisitions; andCommentsClose CommentsPermalink
(ii) section 206 of the Federal Land Policy and Management Act of 1976 (
(B) approved by the Secretary.CommentsClose CommentsPermalink
(3) COSTS- The Council shall pay the reasonable costs of any survey, appraisal, and administrative analyses required by law for the conveyance.CommentsClose CommentsPermalink
(g) Access-CommentsClose CommentsPermalink
(1) IN GENERAL- Access to the land conveyed under subsection (a) shall be via the adjacent land of the Council or a successor of the Council.CommentsClose CommentsPermalink
(2) LIMITATION- Notwithstanding section 1323(a) of the Alaska National Interest Lands Conservation Act (
(h) Additional Terms and Conditions- The conveyance under subsection (b) shall be subject to any terms and conditions that the Secretary determines to be in the public interest, including the reservation of access rights to the conveyed land for administrative purposes.CommentsClose CommentsPermalink
