An original concurrent resolution setting forth the congressional budget for the United States Government for fiscal year 2009 and including the appropriate budgetary levels for fiscal years 2008 and 2010 through 2013.

Title I: Recommended Levels and Amounts - (Sec. 101) Lists recommended budgetary levels and amounts, for FY2 more...008-FY2013, with respect to: (1) federal revenues; (2) new budget authority; (3) budget outlays; (4) deficits; (5) public debt; and (6) debt held by the public. (Sec. 102) Lists the appropriate levels of new budget authority, outlays, and administrative expenses for Social Security, U.S. Postal Service discretionary administrative expenses, and specified major functional categories for FY2008-FY2013. Title II: Budget Process - Subtitle A: Direct Spending and Receipts - (Sec. 201) Requires the Director of the Congressional Budget Office (CBO) to prepare for each bill and joint resolution reported from committee (including amendments and conference reports), except measures within the Committee on Appropriations' jurisdiction, an estimate of whether the measure would cause, relative to current law, a net increase in deficits in excess of $0 in any of the four consecutive 10-year periods beginning with the first fiscal year that is a decade after the budget year provided for in the most recently adopted concurrent resolution. Makes it out of order to consider in the Senate any legislation that would cause such a net increase in deficits in such periods. Permits waiver or suspension of such prohibition, or successful appeals from rulings of the Chair, only by an affirmative vote of three-fifths (60) of the Senate. (Sec. 202) Makes it out of order to consider in the Senate any reconciliation bill, joint resolution, motion, amendment, or conference report, or an amendment between the chambers in relation to such legislation, that produces an increase in outlays, if: (1) the effect of all the provisions in a committee's jurisdiction is to create gross new direct spending that exceeds 20% of the total savings instruction to the committee; or (2) the effect of the adoption of an amendment would result in such spending. Permits waiver or suspension of such prohibition, or successful appeals from rulings of the Chair, only by an affirmative vote of three-fifths (60) of the Senate. Subtitle B: Discretionary Spending - (Sec. 211) Makes it out of order to consider in the Senate any legislation that would cause the discretionary spending limits in this section to be exceeded. Permits waiver or suspension of such prohibition, or successful appeals from rulings of the Chair, only by an affirmative vote of three-fifths (60) of the Senate. Extends Senate discretionary spending limits for FY2008-FY2009. Provides for adjustments to discretionary spending limits, budgetary aggregates, and allocations for: (1) continuing disability reviews and Supplemental Security Income (SSI) redeterminations for the Social Security Administration (SSA); (2) Internal Revenue Service (IRS) tax enforcement; (3) health care fraud and abuse control; (4) unemployment insurance improper payments reviews; (5) comparative effectiveness research at the Agency for Healthcare Research and Quality; (6) reduction of waste in defense contracting; (7) adjustments for the costs of the wars in Iraq and Afghanistan; and (8) supplemental appropriations for FY2008, if such legislation is enacted. Requires all Senate committees to: (1) review programs within their jurisdictions to root out waste, fraud, and abuse in program spending, giving particular scrutiny to issues raised by Government Accountability Office (GAO) reports; and (2) include in their annual views and estimates reports to the Committee on the Budget, based on such oversight efforts and committee performance reviews, recommendations for improved governmental performance. (Sec. 212) Makes it out of order to consider in the Senate any legislation that would require advanced appropriations other than for: (1) any FY2010-FY2011 programs, projects, activities, or accounts identified in the accompanying joint explanatory statement of managers, but only in an aggregate of up to $29.352 billion in new budget authority in each year; and (2) the Corporation for Public Broadcasting. Permits waiver or suspension of such prohibition, or successful appeals from rulings of the Chair, only by an affirmative vote of three-fifths (60) of the Senate. (Sec. 213) Makes it out of order to consider in the Senate any legislation which includes a provision that constitutes a change in mandatory programs producing net costs that would have been estimated as affecting direct spending or receipts under the Balanced Budget and Emergency Deficit Control Act of 1985 (Gramm-Rudman-Hollings Act) were they included in non-appropriations legislation. Subjects such a provision to a point of order if: (1) it would increase budget authority in at least one of the nine fiscal years that follow the budget year and over the total of the budget year and the nine ensuing fiscal years; (2) it would increase net outlays over the total period of such ensuing fiscal years; and (3) the sum total of all changes in mandatory programs in the legislation would increase such net outlays. Permits waiver or suspension of such prohibition, or successful appeals from rulings of the Chair, only by an affirmative vote of three-fifths (60) of the Senate. (Sec. 214) Requires the joint explanatory statement accompanying the conference report on any budget resolution in the Senate to include in its allocations to the Committee on Appropriations amounts for the discretionary administrative expenses of the Postal Service. Subtitle C: Other Provisions - (Sec. 223) Makes it out of order to consider a budget resolution in the Senate unless it contains a specified debt disclosure section. Declares that, if any portion of the Social Security surplus is projected to be spent and/or the gross federal debt in the fifth year of the budget window is greater than the debt projected in the current year, as described in such debt disclosure, the budget resolution report, print, or accompanying statement of managers shall contain a section that: (1) details the circumstances making it in the national interest to allow federal debt to increase rather than taking steps to reduce it; and (2) provides a justification for allowing the surpluses in the Social Security Trust Fund to be spent on other federal functions even as the baby boom generation retires, program costs are projected to rise dramatically, the debt owed to Social Security is about to come due, and the Trust Fund is projected to go insolvent. (Sec. 224) Declares that the levels assumed in this budget resolution: (1) allow the gross federal debt of the nation to rise by $2 trillion from FY2008 to FY2013; (2) allow such debt to rise by $6,440 on every U.S. citizen from FY2008 to FY2013; and (3) project $800 billion of the Social Security surplus that will be spent FY2009-FY2013 on things other than Social Security, which represents 70% of such projected Social Security surplus over this period. (Sec. 226) Requires the budget resolution for any year the CBO report projects an on-budget deficit (excluding Social Security) to: (1) reduce on-budget deficits relative to the CBO projections and put the budget on a path to achieve on-budget balance within five years; and (2) include such necessary provisions to protect Social Security and facilitate deficit reduction. Prohibits reductions in Social Security benefits. Makes it out of order to consider in the Senate a budget resolution for such a budget year or any conference report that fails to reduce such on-budget deficits and put the budget on such a path. Makes it out of order to consider in the Senate an amendment to a budget resolution that would increase on-budget deficits relative to such resolution in any fiscal year covered by it or cause the budget to fail to achieve such on-budget balance. Suspends these requirements and prohibitions if: (1) the most recent of the Department of Commerce's advance, preliminary, or final reports of actual real economic growth indicate that the rate of real economic growth (as measured by the real gross domestic product) for each of the most recently reported quarter and the immediately preceding quarter is less than 0; or (2) a declaration of war is in effect. Permits waiver or suspension of such prohibitions, or successful appeals from rulings of the Chair, only by an affirmative vote of three-fifths (60) of the Senate. Title III: Reserve Funds - (Sec. 301) Provides for certain deficit-neutral reserve funds, subject to certain conditions, for legislation for: (1) strengthening and stimulating the American economy and providing economic relief to American families; (2) improving education; (3) investing in America's infrastructure; (4) investing in clean energy, preserving the environment, and providing for certain settlements; (5) providing for America's veterans and wounded servicemembers, including a post 9/11 GI bill; (6) improving America's health; (7) revising judicial pay and judgeships; (8) revising the alternative minimum tax (AMT) for individuals; (9) repealing the 1993 increase in the income tax on Social Security benefits; (10) improving energy efficiency and production; (11) studying the effect of cooperation with local law enforcement; (12) terminating deductions from mineral revenue payments to states; (13) establishing state Internet sites for disclosure of information relating to state Medicaid payments; (14) improving the animal health and disease program; (15) implementing the Yellow Ribbon Reintegration Program for members of the National Guard and Reserve; (16) reimbursing states for the costs of housing undocumented criminal aliens; (17) accelerating phased-in eligibility for concurrent receipt of benefits for members of the Armed Forces; (18) reducing the income threshold for the refundable child tax credit to $10,000 with no inflation adjustment; (19) processing naturalization applications; (20) accessing quality and affordable health insurance; and (21) banning Medicare Advantage and prescription drug plan sales and marketing abuses. Provides for certain deficit-neutral reserve funds for legislation for: (1) immigration reform and enforcement; (2) border security, immigration enforcement, and criminal alien removal programs; (3) science parks; (4) a three-year extension of the pilot program for national and state background checks on direct patient access employees of long-term care facilities or providers; (5) traumatic brain injury programs; (6) increased use of recovery audits; (7) food safety; (8) a demonstration project for state Medicaid coverage of low-income HIV-infected individuals; (9) education reform; and (10) a 9/11 health program. (Sec. 307) Expresses the sense of the Senate on: (1) Medicaid administrative regulations; (2) the diversion of funds set aside for the U.S. Patent and Trademark Office (USPTO); (3) a one-year extension, under the same terms and conditions, of the "Moving to Work Agreement" between the Philadelphia Housing Authority and the U.S. Department of Housing and Urban Development (HUD); (4) a balanced budget amendment to the U.S. Constitution; and (5) the need for comprehensive legislation to legalize the importation of prescription drugs from highly industrialized countries with safe pharmaceutical infrastructure.
