I was curious, if in thinking about protecting America’s workers, was any thought put into protecting those who protect America’s workers? As the economy struggles, CSHO’s/enforcement personell, are running into more and more distraught, and upset employers. In states like Alaska, Nevada, Utah, where CSHO’s may be required to go into the wilderness, or area’s without cell phone service, or the ability to call for help in case of confrontation, thought not saught after. What rights, or abilities do they have to protect themselves from an employer who means them harm?
“SEC. 311. OSHA CRIMINAL PENALTIES.
‘(f)(1) Any employer who willfully violates any standard, rule, or order promulgated pursuant to section 6 of this Act,…, and that violation caused death to any employee, shall, upon conviction, be punished by a fine…or by imprisonment…”
The only way this section will ever be enforced is if there is a provision in the bill that in such cases, OSHA will be represented by the Justice Department. OSHA does not have adequate legal representation. Its attorneys come from the USDOL solicitors office and, in some cases, these attorneys are terrified of corporate and beltway law firm attorneys. They will refuse to support the case and will find a host of reasons why the case cannot be litigated. OSHA needs litigators. If it is not specified that such cases will be handled by adequate counsel to OSHA, this section will end up like Section 17(g) of Public Law 91-596 (OSH Act) which specifies fines or jail for liars — it will never be enforced.
Seven states have mandatory training for osha 10 to protect workers. NY is one of them. Protect your workers and comply with the law in NY.
