11/6/2009--Introduced.Directs the Secretary of Health and Human Services (HHS), with respect to a state in the calculation for it of the Federal Medical Assistance Percentage (FMAP), to substitute the state's average historical per capita income for a year in any instance for which the Secretary would use the state's per capita income for such year if:(1) in such year the state's per capita income exceeds the average historical per capita income by at least 8%; and
(2) during such year or any of the two previous years a major disaster was declared in the state by the President under the Robert T. Stafford Disaster Relief and Emergency Assistance Act.
