10/6/2009--Introduced.Protecting Older Workers Against Discrimination Act - Amends the Age Discrimination in Employment Act of 1967 to declare that a plaintiff establishes an unlawful employment practice if the plaintiff demonstrates by a preponderance of the evidence that:
(1) an impermissible factor or authority was a motivating factor for the practice complained of, even if other factors also motivated that practice; or
(2) the practice complained of would not have occurred in the absence of an impermissible factor. Specifies the types of:
(1) evidence that a plaintiff may utilize; and
(2) relief and damages available to a successful plaintiff.
