"(b)(1) An authorization to use military force, a declaration of war, or any similar authority shall not authorize the detention without charge or trial of a citizen or lawful permanent resident of the United States apprehended in the United States, unless an Act of Congress expressly authorizes such detention."
The problem with the 2012 NDAA is that it greatly expands who can be considered a "terrorist", and now ... -

We are writing as your constituents, in the 2nd Congressional district of Missouri, in support of S.2003 - Due Process Guarantee Act of 2011. Though additionally it should be amended to make due process unconditional; thus removing provision that would allow congress to suspend such by future legislation.
This should all be moot, as our constitution makes any such suspension of due process illegal. But unfortunately the NDAA legislation of last year has made this act necessary.
