    I liked it pretty well until it got to where it stiplulated intent. Intent either should not be involved as some people have suffered from consequences of bad judgements from Doctors. My sister had her gall bladder taken out yet, the Doctor recommended it. He had no ill intent, but today she has a hernia. She should be able to recover from that.

    OPPOSE this HORROR bill S.218, similar to H.R. 5 – this hurts every American! This bill was introduced by Senator Ensign, you must not trust him. He resigned amid an investigation of an ethics violation in May 2011. These bills will mean no lawsuits, no recovery and an enormous burden on tax-funded programs (hurt, non-compensated victims – lifetime dependency on Government support). Studies show that tort reform at the state level has been ineffective in reducing medical costs or reducing medical malpractice premiums for doctors. In Nevada, state law caps the amount a victim of medical negligence can recover, but instead of reducing costs, prices have risen dramatically.

    These caps prevent the most seriously injured patients from recovering fully for the injuries, and only serves to enrich insurance companies. Furthermore, because medical malpractice suits result in less than .5% of total health care costs, malpractice reform would do little to lower the overall cost of health care. With over 98,000 deaths each year caused by preventable medical errors, I believe that encouraging safe medical practices should be one of the most important goals of health care reform. Preventing these errors will not only lower health care costs, but also protect the health and well being of patients.

    S. 218 and H.R. 5 are unreasonable risks to our health care, an elimination of our 7th Amendment Right, safety and freedom. These bills would give full immunity to tortfeasors, like Abbott Laboratories (Abbott/TAP convicted criminals) and significantly increase health care costs and safety risks. Harm by Bill to All Americans: 1) Immunity, Handout for Wrongdoers in Medical Industry – Fool’s License = Unsafe, More Victims – Disabled Victims of Doctors – Medical Malpractice and Dangerous Drugs – Irresponsible Greedy Pharma / Victims Never Get Fair Compensation – ZERO Punitive Damages / Creates Lifetime Dependency On Government Payments / Severe Burden On Tax Funded Programs 2) Anti Patient Bill of Rights & Unconstitutional – Against 7th Amendment Right etc. see letter for info
