Dear Keith,
Thank you for taking the time to contact my office regarding H.R. 1540, the National Defense Authorization Act (NDAA). This dialogue is very important to me as your representative.
The NDAA authorized appropriations for the Department of Defense for fiscal year 2012. This bill is representative of one of the key roles of Congress and the federal government, to "provide for the common defense.” I supported this measure because of the importance of furnishing our troops with the proper gear and protecting the American people from foreign threats. This legislation deals with military personnel policy, education and training, military pay and allowances, and management. By recognizing the importance of spending reduction measures, as well as the importance of a strong national defense, the National Defense Authorization Act adequately addresses our nation's military needs.
The House and Senate produced a Conference Committee Report on the NDAA, which was released on December 12, 2011. Section 1021 of this report contained the provisions to ensure that anyone who “was a part of or substantially supported al-Qaeda, the Taliban, or associated forces that are engaged in hostilities against the United States or its coalition partners” would be detained under the law of war. Section 1021(e) of the NDAA goes on to state that “Nothing in this section shall be construed to affect existing law or authorities relating to the detention of United States citizens, lawful resident aliens of the United States, or any other persons who are captured or arrested in the United States.”
Because of concerns raised by many, including myself, over this language, I am an original co-sponsor of H.R. 3676: this legislation retroactively amends this language to explicitly state that no American citizen may be held against their will without all rights of due process afforded them by the Constitution.
