Dear Mr. Johnston,
Thank you for contacting me to express your concerns with the detainee
provisions of H.R. 1540, the National Defense Authorization Act for
Fiscal Year 2012. I appreciate hearing from you on this important
issue.
I understand your concerns with H.R. 1540 and agree that all measures
must be taken to protect the constitutional rights of U.S. citizens,
that is why I am a cosponsor of H.R. 3676. Like you, many people have
expressed concerns with the provision requiring military custody of
foreign terrorist suspects. Specifically, there are concerns that this
provision would authorize indefinite military detention for U.S.
citizens. As you know, H.R. 3676 would amend H.R. 1540 to clarify that
its detainee provisions do not apply to U.S. citizens and legal alien
residents.
While paragraph (e) of section 1021, as well as paragraph (b)(1) and
(2) of section 1022 states that the authority to indefinitely detain
foreign terrorist suspects does not extend to U.S. citizens or legal
alien residents, H.R. 3676 ensures that no ambiguity exists when it
comes to the constitutional rights of U.S. citizens. H.R. 3676
clarifies that these authorities will not undermine our civil liberties
and ensures that U.S. citizens are protected against unlawful
detention. Please be assured that I will always fight to protect the
constitutional rights of American citizens and vote against any
legislation that degrades these rights.
