Dear Mr. Antonucci:



Thank you for contacting me to express your opposition to applying sales
taxes to all purchases from Internet retailers. I appreciate the time
you took to write and apologize for the delay in my response.



I understand your concern that the taxation of Internet commerce could
pose challenges to small businesses that predominantly operate online.
As you know, retailers are required to charge sales tax if a transaction
takes place in a state where the retailer has significant business
operations. However, there is currently no requirement for retailers to
charge sales tax to out-of-state customers. On July 29, 2011 Senator
Richard Durbin (D-IL) introduced the "Main Street Fairness Act" (S.
1452), which would require retailers to remit to states sales taxes owed
on remote purchases. This bill is currently awaiting consideration by
the Senate Committee on Finance, of which I am not a member.



You may be interested to know that on February 16, 2011 Representative
Daniel Lungren (R-CA) introduced a House Resolution (H. Res. 95), which
would encourage the House of Representatives not to pass legislation
taxing internet sales. Because this is a House Resolution, and not a
bill, it will not appear before the Senate, even if agreed to by the
House. Please know, however, that I will keep your concerns in mind
should the Senate consider legislation related to this issue in the
112th Congress.
