    • On April 29, 2011, by fgiles - This is a good bill but I feel that there are a few problems with the bill that can be easily fixed. I work for a CRA that provides background screening and drug testing to the industry. This bill does not recognize that CRAs act as agents for many in the transportation industry. CRAs acting as the agents of transportation employers should be allowed access to the database on behalf of the employer so that the information can be included in a consolidated report for the employer. Further, the bill as proposed requires that a signed consent be obtained and physically presented to release information. I suggest that the FCRA consent model be employed, specifically a notification and consent is required to be obtained and maintained on file, but the employer or agent may provide a e-certification that the consent was obtained rather than requiring the physical consent itself. Both fixes will preserve the rights of workers while getting them to work faster.

CDL Drivers share the road with passenger and other non-commercial drivers within a fraction of the liability. There are statistics to substantiate this rulemaking. There is a broader spectrum of responsibility and accountability that is relevant to deepen the law making process relevant to the safety and liability of insurance companies for passengers and drivers.
