If the NSA believes it needs to conduct extra-legal datamining to do its job it needs to take that concern through the appropriate judicial channels - such as the FISA court - in order to make that happen. "Lagging behind the enemy" may not appeal to you, but I think the idea that there needs to be some separation of powers between the various branches of government is also worth protecting.

Telecommunications firms should not receive immunity for conducting illegal data-mining experiments on the web traffic and phone calls of citizens. End of story.

Rhetoric aside, this bill will help protect the open architecture of the internet. That architecture has enabled the net to become a powerful source of innovation, economic growth, and cultural production. The telecommunications market in the US is so heavily concentrated that the action of the congress is needed to protect the Internet and its users from the rent-seeking tendencies of broadband providers and network owners.
