- Anonymous : If you were talking about a zipper, or some other fastener, then yes, Patent law would rule here. But we are talking about a design of fabric with varying shapes and colors, which is art, thusly belonging to copyright protection. Patent and trademark law does not, nor should it work here. This is not a little "Swoosh" sign by NIKE, or a little polo player and horse for Ralph Lauren's Polo label (all of which fall under trademark law), or the aforementioned zipper, button, or lacing system (which would be a patent). Promote this bill. Oppose any other action. Study your intellectual properties before opposing bills.
- adelie : This is also S.1957 Also, to anyone thinking of supporting this bill, please look at and understand trademark law and patent law a bit first, and explain why we need to change the scope of copyright law to specifically address the fashion industry. Patents and trademarks provide enough protection, meanwhile the whole system is enough of a mess that we don't need to start giving out patent and trademark rights through copyright law to specific industries. It would be more appropriate to work on a way to make a simple fast track 3 year patents for the fashion industry that wouldn't require nearly the expense or difficulty of a full 17 year patent. They are changing the wrong law. Make them get it right and oppose this bill.

- adelie : After reading the fashion design blog, I had some other thoughts: As mentioned in the article, it is easy to tell a knock off from the original. Is there really so many problems with this 'piracy' that people don't want the newest trendy thing because it looks like the knockoff everyone else wears? I don't think so. Trademark law protects designers and consumers from these plagiarized works by uniquely allowing them to mark them in a way that will distinguish them. People know and respect Prada for their innovative and classy designs, with their superior craftsmanship, and it can't be mistake for the $10 slave labor knockoff. If people are copying their trademark, then there is STRONG legal protection that already lasts forever. A 3 year 'special' copyright would distort the intended scope of copyright (USC 17 SEC 102), and set a bad precedent, despite the understandably good intentions of the CFDA.
- adelie : Is there any reason why this can't be an extension of patent law? It is important that the scope of copyright is maintained and that there continues to be clear rules between copyright and patent. If there is a concern for 'uniquely identifying a product or service' authenticity, use a trademark. That is what trademark law is for. Are they really going to try to argue that name branding hasn't a positive impact on the sale of high end fashion items? The law is already there to protect them. Vote NO!

You know how it’s common knowlege that most appeals aren’t successful? Well, if you were a pro-se petitioner in Louisiana for the last 13 years, you knew that you wouldn’t win. Why is that? Because the Chief Judge of their Court of Appeals directed his clerk to summarily deny all appeals from pro-se petitioners without circulating the appeal to other judges. The clerk, ridden with guilt, committed suicide earlier this year and left a note confessing everything. This immoral and apparently illegal policy was in place until Jerrold Peterson, the staffer charged with implementing it, blew his brains out in May of last year. Peterson was driven to it in part, his suicide note suggested, by guilt over the nefarious tasks the judges made him perform. In his note Peterson explained how the court gave indigent appellants the bum’s rush. Although every criminal writ application is supposed to be reviewed by three judges, he was deputed to winnow out any that had been filed pro se and arrange for their automatic rejection. Thus were an estimated 2,500 appeals deep-sixed without any judicial consideration whatsoever. Now, facing public embarassment and possible ethical violations, the Louisiana Supreme Court has stepped in and asked…get this…the same appellate court to look at the appeals again. Note that they did not ask the Court to conduct an investigation into this practice, but simply to consider those appeals that were so summarily denied. Because, if we placate the defendants with another cursory look at their appeals, we can sweep the ethical violations under the carpet. At first this whole thing seemed rather odd to me. After all, how is this even possible? Here’s how: Edward Dufresne, Chief Judge of the Fifth Circuit, took charge of pro se appeals in 1994. He then had Peterson prepare rulings denying writs for all of them and signed off “without so much as a glance,” according to the suicide note. “No judge ever saw the writ application before the ruling was prepared by me,” Peterson wrote in a second suicide note to the Judiciary Commission. The rulings also bore the names, though not the signatures, of judges Marion Edwards and Wally Rothschild. Neither Edwards nor Rothschild had any clue as to what was in the applications, or even knew that they had been filed, according to Peterson. So you’ve got one complicit judge and maybe three. But there are 5 more on that court. What of them? Are we to really believe that these 5 (or 7) other judges never once questioned the stark absence of pro-se appeals? Particularly in Louisiana, whose system has the following characteristics: * About 90 percent of criminal defendants in Louisiana are indigent. * Louisiana only provides post-conviction legal aid in death penalty cases. Everyone else must either hire a lawyer, find a lawyer to handle their case pro bono, or handle the appeal themselves. Obviously, most have no choice but to opt for the latter. * One criminal defense lawyer in Louisiana told me that if you’re convicted of murder in Louisiana and you’re innocent, you’re actually better off getting the death penalty. At least then you’ll get a team of lawyers, investigators, and experts to help with your appeal. This from a state whose criminal justice system was already crumbling. It’s hard to believe that people such as Judge Dufresne take an oath to uphold the law and to prove equal protection under it. Disbarment may be enough, but only barely. - americausa : I have been out of work since November 2007. My unemployment benefits ran out last month. I am 53 old and have worked hard all my life. I've paid taxes all my life, and this is how my country is treating me. Unbelievable. Totally disgusting. So anytime I am not looking for a job, I will spend time and dedicate to making sure any politician that votes nay on not extending unemployment insurance will be out of a job their next term by informing the public of their decision in every forum available. You know how it’s common knowlege that most appeals aren’t successful? Well, if you were a pro-se petitioner in Louisiana for the last 13 years, you knew that you wouldn’t win. Why is that? Because the Chief Judge of their Court of Appeals directed his clerk to summarily deny all appeals from pro-se petitioners without circulating the appeal to other judges. The clerk, ridden with guilt, committed suicide earlier this year and left a note confessing everything. This immoral and apparently illegal policy was in place until Jerrold Peterson, the staffer charged with implementing it, blew his brains out in May of last year. Peterson was driven to it in part, his suicide note suggested, by guilt over the nefarious tasks the judges made him perform. In his note Peterson explained how the court gave indigent appellants the bum’s rush. Although every criminal writ application is supposed to be reviewed by three judges, he was deputed to winnow out any that had been filed pro se and arrange for their automatic rejection. Thus were an estimated 2,500 appeals deep-sixed without any judicial consideration whatsoever. Now, facing public embarassment and possible ethical violations, the Louisiana Supreme Court has stepped in and asked…get this…the same appellate court to look at the appeals again. Note that they did not ask the Court to conduct an investigation into this practice, but simply to consider those appeals that were so summarily denied. Because, if we placate the defendants with another cursory look at their appeals, we can sweep the ethical violations under the carpet. At first this whole thing seemed rather odd to me. After all, how is this even possible? Here’s how: Edward Dufresne, Chief Judge of the Fifth Circuit, took charge of pro se appeals in 1994. He then had Peterson prepare rulings denying writs for all of them and signed off “without so much as a glance,” according to the suicide note. “No judge ever saw the writ application before the ruling was prepared by me,” Peterson wrote in a second suicide note to the Judiciary Commission. The rulings also bore the names, though not the signatures, of judges Marion Edwards and Wally Rothschild. Neither Edwards nor Rothschild had any clue as to what was in the applications, or even knew that they had been filed, according to Peterson. So you’ve got one complicit judge and maybe three. But there are 5 more on that court. What of them? Are we to really believe that these 5 (or 7) other judges never once questioned the stark absence of pro-se appeals? Particularly in Louisiana, whose system has the following characteristics: * About 90 percent of criminal defendants in Louisiana are indigent. * Louisiana only provides post-conviction legal aid in death penalty cases. Everyone else must either hire a lawyer, find a lawyer to handle their case pro bono, or handle the appeal themselves. Obviously, most have no choice but to opt for the latter. * One criminal defense lawyer in Louisiana told me that if you’re convicted of murder in Louisiana and you’re innocent, you’re actually better off getting the death penalty. At least then you’ll get a team of lawyers, investigators, and experts to help with your appeal. This from a state whose criminal justice system was already crumbling. It’s hard to believe that people such as Judge Dufresne take an oath to uphold the law and to prove equal protection under it. Disbarment may be enough, but only barely. Spying and torture has become a common practice to any individual living or not living the productive life, people who live peacefully, people who are satisfied with their lives. Once the Government considers a person or persons an outsider, they are considered alien and a danger to the society. The government fears these people for their disrupting the overall progress of the American Way. Growth and prosperity, has become a major concern to those people dwelling in luxury and vanity, while individuals who are satisfied with the common way of living are scrutinized and condemned for being lazy and indifferent to any advancement. America is the product of devastation to the planet Earth, and the realm of outer space. The government has sold-out to the destruction of this planet with endless violations, removing the material resources and destroying natural environment, ending nearly all ecosystems for the natural forms of life. Feb, 25 08 http://news.yahoo.com/s/ap/20080126/ap_on_go_ot/dead_satellite Nothing in this world is more alarming then the fact that United States Citizens are being attacked and done harm by the U S Government Satellite Program. I was attacked while in Ohio early last year, March and April, after some traveling to Oklahoma, and on to Amarillo, Texas. Apparently, this torturing started before my trip West, for I suffered substantially, prior to that time, not realizing what was happening to me. Throughout 06-07 winter, October until the time I went on my journey West in March, I suffered an agonizing experience of an equal consequence. At that time, I consider it much more evil and more deadly, for it was done within my home, day and night, while sleeping, while eating, while using the bathroom. This onslaught of atrocities was done even though I tried to stop it. You may ask “how can a person be harm, tortured, I would say, within their home and not be able to defend themselves.” My understanding was revealing when I thought back to how Russia, in the Cold War, beamed energies into the United States Embassy office building in Moscow, Russia. It wasn’t until some time that the administrations in Moscow realize what was happening, mainly because there was no way of knowing what was happening to the individuals while on duty. I don’t remember the details of the occurrences, but apparently the people there at the Embassy became sickly and this bombardment of energies hindered their work. Could it be possible these same covert tactics are being used in United States of America? Could the government in this country pick out individual citizens that may have irritated a few people, doing them harm? The only reason I’m able to protect myself from this tormenting affect, is my understanding of what actually happened in the Embassy in Moscow. Dual beams of energy at a specific frequency converging at some designated intersect, namely me while minding my affairs here in my home, tormenting and doing me harm. I’m sure you are extremely hesitant about even thinking such a thing is happening. Jan. 28, 08 Nothing in this world is more alarming then the fact that United States Citizens are being attacked and done harm by the U S Government Satellite Program. I was attacked while in Ohio early last year, March and April, after some traveling to Oklahoma, and on to Amarillo, Texas. Apparently, this torturing started before my trip West, for I suffered substantially, prior to that time, not realizing what was happening to me. Throughout 06-07 winter, October until the time I went on my journey West in March, I suffered an agonizing experience of an equal consequence. At that time, I consider it much more evil and more deadly, for it was done within my home, day and night, while sleeping, while eating, while using the bathroom. This onslaught of atrocities was done even though I tried to stop it. You may ask “how can a person be harm, tortured, I would say, within their home and not be able to defend themselves.” My understanding was revealing when I thought back to how Russia, in the Cold War, beamed energies into the United States Embassy office building in Moscow, Russia. It wasn’t until some time that the administrations in Moscow realize what was happening, mainly because there was no way of knowing what was happening to the individuals while on duty. I don’t remember the details of the occurrences, but apparently the people there at the Embassy became sickly and this bombardment of energies hindered their work. Could it be possible these same covert tactics are being used in United States of America? Could the government in this country pick out individual citizens that may have irritated a few people, doing them harm? The only reason I’m able to protect myself from this tormenting affect, is my understanding of what actually happened in the Embassy in Moscow. Dual beams of energy at a specific frequency converging at some designated intersect, namely me while minding my affairs here in my home, tormenting and doing me harm. I’m sure you are extremely hesitant about even thinking such a thing is happening. Yes, this was my first thought when Satellites defense technology came to mind, “is it possible?” “Could it be, someone like me, being under surveillance, attacked by such high tech equipment?” No Way! - lerichards : Feb. 28, 2008 The U S Government has become dangerous to all U S Citizens. Fear has gripped the Government and many people of The United States, causing havoc among all citizens. Not in history of civilization has such atrocities been realized. Spying and torture has become a common practice to any individual living or not living the productive life, people who live peacefully, people who are satisfied with their lives. Once the Government considers a person or persons an outsider, they are considered alien and a danger to the society. The government fears these people for their disrupting the overall progress of the American Way. Growth and prosperity, has become a major concern to those people dwelling in luxury and vanity, while individuals who are satisfied with the common way of living are scrutinized and condemned for being lazy and indifferent to any advancement. America is the product of devastation to the planet Earth, and the realm of outer space. The government has sold-out to the destruction of this planet with endless violations, removing the material resources and destroying natural environment, ending nearly all ecosystems for the natural forms of life. The elderly, in their time to relax and enjoy the things they have accomplished, the government relentlessly hounds, reminding the retired they are still useful and can be of some consequence to the community around them. The government continues to rely on production and progress, the very accomplishments that are burying any hopes of this planet Earth from ever recovering from absolute destruction. The End
