Duncan was born July 21, 1947, in Lebanon, Tennessee. He graduated from the University of Tennessee at Knoxville in 1969 with a Bachelor of Science degree and subsequently received a Doctorate of Jurisprudence degree from George Washington University in Washington, D.C. in 1973 and was admitted to the bar that same year. He was an attorney in private practice until he became a state court judge in Knox County, Tennessee, where he served from 1981 to 1988.
